BEACON MART PRIVACY NOTICE

1. INTRODUCTION

Beacon Mart Holdings Sdn. Bhd. and its affiliates (individually and collectively, “Beacon Mart”, “we”, “us” or “our”) care about your personal data protection, and are committed to protecting your personal data in compliance with applicable privacy laws and regulations. This privacy notice (“Notice”) explains how we collect, use, disclose, and protect personal data you have provided to us and/or we possess about you, whether before, now or in the future.

By providing us with your personal data and continuing to use our services, you signify that you have read and understood this Notice and you explicitly consent to us processing your personal data in accordance with this Notice (including any personal data previously collected). This also includes the data collected via our website, mobile application, in-store registration, or third-party partners with consent.

2. DATA COLLECTION

2.1 Personal Data

We may collect your personal data, when you:

  • register your details at our outlets or via our e-commerce platforms;
  • make purchases online or in-store;
  • join our membership or loyalty programs;
  • sign up for staff and affiliate purchase;
  • sign up as an agent, or engage with our social media, advertisements, or surveys; and/or
  • submit your personal data to us for any reason.

The above is not intended to be exhaustive and is meant to set out some common instances in which your personal data may be collected.

The types of personal data that we may collect include name, date of birth, identification card or passport number, address, email address, phone number, purchase history, and bank account number, and basic payment information (excluding full card numbers).

2.2 Cookies

We, along with our authorized service providers and advertising partners, may use cookies and similar technologies from time to time to collect and share information related to your use of our platform and services. These technologies enhance your user experience by helping us:

  • improve the performance and functionality of our platform;
  • develop and offer new features and services; and
  • deliver content and advertisements that are more relevant to your interests, including through remarketing strategies.

3. PURPOSE OF PROCESSING

We may collect, use, disclose and/or process your personal data for one or more of the following purposes:

  • to register you as a customer or member;
  • to respond to, process, deal with or complete a transaction, purchases and product delivery, and notify you of service issue;
  • to manage complaints or your requests, provide after-sales services, manage loyalty programmes;
  • to send promotional and marketing materials to you, including interest-based advertising such as targeted communications and personalized offers;
  • to conduct analysis, development and improvement programme to improve our services or products and/or to enhance your customer experience;
  • to comply with relevant laws or regulations on reporting and disclosure (where required); 
  • to store, host and/or back up your personal data whether within or outside Malaysia; and or;
  • any other purposes not appear above, which we may notify you at the time of obtaining your consent. 

4. DISCLOSURE TO THIRD PARTIES

We may use, process, disclose, transfer and/or share your personal data with third parties, which may be located within or outside of Malaysia, for one or more of the purposes stated in Section 3 above.

Such third parties include, without limitation:

  • logistics & courier partners;
  • appointed data processors (under contract);
  • service providers for information technology, payment gateway, and marketing;
  • government authorities which have jurisdiction over us.

IN PARTICULAR, WE MAY SHARE YOUR PERSONAL DATA, INCLUDING CONTACT INFORMATION, SHOPPING PREFERENCES, AND BEHAVIOUR, WITH OUR SUBSIDIARIES, AFFILIATES, AND TRUSTED THIRD-PARTY PARTNERS FOR THE PURPOSE OF MARKETING, ADVERTISING, AND INTEREST-BASED ADVERTISING.

We endeavour to ensure that sharing of your personal data will only occur with parties that adhere to privacy practices at least as protective as those outlined in this Notice and comply with applicable data protection laws, and your personal data is securely handled and used solely for the relevant purpose(s).


5. CROSS-BORDER TRANSFER

Your personal data and/or information may be transferred to, stored or processed outside of Malaysia for one or more of the purposes. In most cases, your personal data will be processed in Malaysia, where our servers are located. We will only transfer your personal data outside Malaysia if the destination has adequate data protection laws.


6. SECURITY MEASURES

We take the security of your personal data seriously and implement a range of measures to safeguard it within our systems, such measures include internal access control, data encryption, staff training and internal audits, and contractual safeguards with third-party processors to protect your personal data. While we strive to protect your personal data, please note that no method of transmission or storage is completely secure, and we cannot guarantee absolute security.


7. DATA RETENTION

Your data may be retained for as long as you remain our customer or as necessary to fulfil the purpose it was collected, in accordance with the applicable privacy laws. Typically, we retain personal data for up to seven (7) years for audit/financial compliance requirements, and to address any potential contractual disputes. We will destroy your data when we have reasonably determined that (i) the purpose for which it was collected is no longer being served by the retention of such data; and (ii) retention is no longer necessary for any legal or business purposes.


8. YOUR RIGHTS

You have the right to access and correct data, withdraw consent, limit processing, and request deletion (if no legal obligation applies). We will need enough information from you in order to ascertain your identity as well as the nature of your request so as to be able to deal with your request. We may charge you a reasonable fee for the handling and processing of your requests to access your personal data. If we so choose to charge, we will provide you with a written estimate of the fee we will be charging. Please note that we are not required to respond to or deal with your access request unless you have agreed to pay the fee.

We wish to inform you that if you withdraw your consent, we may no longer be able to provide certain services to you, and we may need to discontinue our relationship with you or terminate any contract you have with us.


This Notice may be amended from time to time and the updated version will be uploaded on our websites.
